The subject of this agreement is the determination of the rights and obligations of the parties, pursuant to the provisions of the Consumer Protection Law No. 6502 and the Distance Contracts Regulation, in relation to the sale and performance of the digital services purchased electronically by the BUYER from the SELLER's nonform.ai platform.

The BUYER acknowledges that, before confirming the order, they have read the Pre-Information Form and have been informed of the matters set out therein. The Pre-Information Form is an integral part of this agreement.

The right of withdrawal is subject to two separate regimes depending on the type of product purchased; these are governed separately in Articles 6 and 7 below. The regime applicable to your order is stated in the header of the order copy in your account.

The services subject to sale are entirely digital:

• Visual/render credits or packages
• Calculation and project outputs: quantity take-off report, technical drawing file (PDF/DXF), cutting and material list, saved project archive
• Fixed-term subscription plans

The current scope, unit prices and any usage limits are set out on the platform's pricing page. All prices are in Turkish Lira (TRY) and include all taxes. As the service is digital, no shipping or delivery costs arise.

Scope limitation: Calculation and drawing outputs are for information and preliminary estimation purposes; they are not an engineering or architectural service, project, structural calculation or building-permit document.

Payments are made by credit card or debit card through the iyzico secure payment infrastructure. Card details are processed by iyzico and are not stored by the SELLER.

The service is not activated before the payment is approved. If the payment is cancelled by the bank, the SELLER's obligation to perform ends.

The purchased service is defined in the BUYER's account and made available for use immediately after the payment is approved. Digital file outputs can be downloaded instantly through the account. There is no physical delivery.

If the service cannot be provided at all due to a technical failure, the amount is refunded.

Pursuant to Article 15 of the Distance Contracts Regulation, which governs the exceptions to the right of withdrawal, the right of withdrawal cannot be exercised in contracts relating to services performed instantly in an electronic environment and intangible goods delivered to the consumer instantly.

Since credit packages and one-off report/drawing purchases are defined in the account immediately upon payment approval and are digital content in nature, they are outside the scope of the right of withdrawal. This article applies only to those products; fixed-term subscriptions do carry a right of withdrawal, which is governed in Article 7.

This matter is brought to the BUYER's attention before order confirmation by means of a separate checkbox that is not pre-ticked; the consent type, text version, date and IP information are recorded.

In fixed-term subscription services the BUYER has, as a rule, the right to withdraw within fourteen (14) days without giving any reason and without paying any penalty.

However, if the BUYER expressly requests that the service be started before the withdrawal period expires, the right of withdrawal is lost once the service has been fully performed. This request is obtained by a separate checkbox before order confirmation and is recorded.

Notice of withdrawal: No formal requirement applies; it is sufficient for the BUYER to send a clear statement to ai.nonform@gmail.com within the period, stating the order number. The SELLER does not require any separate form to be completed.

Refund: In the event of a valid withdrawal, the amount is refunded through the payment method used, within fourteen (14) days at the latest from the date the notice reaches the SELLER. If part of the subscription period has been used, a pro-rata amount is deducted for the period used and the remaining amount is refunded.

The SELLER retains the records relating to the right of withdrawal, pre-information, acceptance of the agreement and performance obligations for three (3) years, pursuant to the Distance Contracts Regulation. Consent records are kept together with the consent type, text version, date, IP address and browser information, and are provided to the BUYER upon request.

The BUYER declares that, before confirming the order, they have read, understood and accepted this agreement and the Pre-Information Form. Matters not covered by this agreement are subject to the legislation in force.

A BUYER who qualifies as a consumer may apply, within the monetary limits announced annually by the Ministry of Trade, to the Consumer Arbitration Committee or the Consumer Court at the place where the service was purchased or where the BUYER resides. For disputes above these limits, and for purchases that do not qualify as consumer purchases (commercial/professional), the Istanbul Courts and Enforcement Offices shall have jurisdiction.

This agreement is concluded electronically, enters into force upon the BUYER's approval, and a copy is sent to the BUYER's email address.
